Terms of Use

Plain-language summary: Hazel Health is a wellness tool, not a medical device. It helps you understand patterns in your body and prepare for doctor conversations — it does not diagnose, treat, or replace medical care. By using the App you agree to these terms.

1. Acceptance of Terms

By downloading, installing, or using Hazel Health (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.

These Terms apply to the App made available by Hazel Health, Inc. ("Hazel Health," "we," "us," or "our"). These Terms incorporate our Privacy Policy by reference.

2. Who Can Use Hazel Health

The App is intended for adults aged 18 and older. By using the App you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

The App is designed for users who are experiencing or interested in perimenopause. It is available for use anywhere the App Store is available, subject to applicable local laws.

3. Not Medical Advice — Important

Hazel Health is not a medical device. It does not provide medical advice, diagnosis, or treatment. The information and insights generated by the App — including the daily card, symptom summaries, health correlations, and the Believe Me Report — are for informational and personal wellness purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider.

Always seek the advice of your physician, OB/GYN, or other qualified health provider with any questions you have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you read or saw in this App.

In the event of a medical emergency, call your local emergency services immediately. Do not rely on the App during a medical emergency.

The doctor finder feature within the App provides information about healthcare providers as a convenience. Hazel Health does not endorse, vouch for, or make representations about any specific provider listed. You are responsible for verifying provider credentials, availability, and insurance coverage independently.

4. Your Account and Responsibilities

Hazel Health does not require account registration. The App stores data locally on your device. You are responsible for:

You agree not to use the App in any way that violates applicable laws or regulations, infringes on the rights of others, or interferes with the proper functioning of the App.

5. HealthKit and Health Data

The App integrates with Apple HealthKit to read health and fitness data from your device and connected wearables. By granting HealthKit permissions, you authorize the App to access the specific data types you approve.

You can revoke HealthKit permissions at any time in iOS Settings → Privacy & Security → Health. Revoking permissions will limit certain features of the App but will not delete any data previously analyzed (which was processed on-device and not stored by us).

You represent that any health data you choose to share with or through the App is accurate to the best of your knowledge, and you understand that inaccurate data may affect the quality of insights the App provides.

6. Apple Intelligence and On-Device Processing

Certain features of the App, including the daily card, require Apple Intelligence to be enabled on your device. Apple Intelligence is Apple's on-device AI framework. Its use is governed by Apple's terms and conditions. Hazel Health has no control over Apple Intelligence availability, performance, or changes Apple may make to it.

If Apple Intelligence is unavailable on your device, affected features will display pre-written fallback content instead of personalized AI-generated insights.

7. The Believe Me Report

The Believe Me Report is a symptom and biometric summary generated on your device and intended to support conversations with your healthcare provider. It is not a medical record, clinical document, or diagnostic tool.

When you share the Believe Me Report with a healthcare provider or any third party, you do so at your own discretion. Hazel Health is not responsible for how third parties interpret or act on the information in the report.

8. Support Subscription

Voluntary Support

Hazel Health offers an optional support subscription ("Hazel Health Support") that funds continued development of the App. All features of the App are available without a subscription. The support subscription does not unlock additional features or provide premium access — it is purely voluntary support for development.

Pricing and Billing

The price of the support subscription is displayed in the App via StoreKit at the time of purchase. Prices are set in your local currency and may vary by region. Subscriptions are billed monthly through your Apple ID and are subject to Apple's standard subscription terms.

Cancellation

You may cancel your support subscription at any time through your Apple ID account settings (Settings → [Your Name] → Subscriptions). Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods, consistent with Apple's standard subscription policies.

Price Changes

If we change the subscription price, we will notify you through the App and via App Store notifications in advance of the change taking effect.

9. Intellectual Property

The App, including its design, text, graphics, software, and all other content, is owned by Hazel Health, Inc. and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works based on the App or any portion of it without our express written permission.

"Hazel Health" and the Hazel Health logo are trademarks of Hazel Health, Inc.

10. User Content

Any symptom notes, logs, or other content you enter into the App ("User Content") remains yours. Because User Content is stored locally on your device and we do not have access to it, you retain full ownership and control. We make no claim to any rights in your User Content.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided by the App, including AI-generated content.

Hazel Health is a wellness application. Health outcomes depend on many factors outside our control. We make no representations about the effectiveness of using the App for any health goal.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HAZEL HEALTH, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR YOUR USE OF THE APP EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Hazel Health, Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App, your User Content, or your violation of these Terms.

14. Third-Party Services and Links

The App may integrate with or link to third-party services, including Apple HealthKit, Apple Intelligence, the App Store, and the doctor finder directory service. These services are governed by their own terms of use and privacy policies. We are not responsible for the practices or content of third-party services.

15. Modifications to the App and Terms

We reserve the right to modify or discontinue the App, or any feature of it, at any time without notice. We will not be liable to you for any modification, suspension, or discontinuation.

We may update these Terms from time to time. Material changes will be communicated through the App. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree to updated Terms, stop using the App.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App will be resolved in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.

You and Hazel Health agree to resolve disputes through good-faith negotiation before initiating formal proceedings.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms will remain in full force.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hazel Health, Inc. regarding your use of the App and supersede all prior agreements on this subject.
